Quick answer: Yes. As of October 12, 2026, hemp-derived THC drinks are legal to sell and buy in Florida for adults 21 and older. Florida sets no milligram cap per can. A federal rule changes that on December 11, 2026, when hemp products above 0.4 mg of total THC per container lose federal hemp protection.

I live in Florida, so this is the question my neighbors ask me most. The state rules are looser than most people expect. The federal deadline is tighter than most people expect. Both matter for what you buy this fall. If you want the statute-by-statute version, read my companion post on whether THC drinks are legal in Florida.

What Florida law says about THC drinks

Florida does not have a THC beverage law. Drinks fall under the state’s general hemp extract rules in Florida Statutes section 581.217 and the Department of Agriculture and Consumer Services (FDACS) rule 5K-4.034. I read both this week. Here is what they require.

  • Age: Hemp extract products intended for ingestion cannot be sold to anyone under 21 (s. 581.217(7)(d)). The statute lists examples that are not limited to the ones named, and it does not mention beverages by name, so treat 21+ as the rule for drinks.
  • Potency: Hemp extract may not exceed 0.3 percent total delta-9 THC on a wet-weight basis (s. 581.217(3)(e)). That is a concentration test. It is not a per-can limit.
  • ID checks: Under rule 5K-4.034, a store must confirm you are 21 before it sells, ships, or delivers the product. Underage sales carry a $5,000 administrative fine per occurrence.
  • Labels: Every container needs a QR code that opens the batch’s lab report, a batch number, an expiration date, and the milligrams of each cannabinoid per serving (s. 581.217(7)(a)).
  • Packaging: Child-resistant packaging that meets ASTM D3475-20. FDACS said in a June 2, 2025 bulletin that standard aluminum tab-top cans generally qualify.

Florida lawmakers tried to add beverage-specific rules in 2026. House Bill 801 would have created a special retail license for THC drinks. House Bill 1409 would have named THC-infused beverages in the under-21 ban. Both died in subcommittee on March 13, 2026, per the Florida Legislature’s bill pages. Nothing new passed.

Why “no milligram cap” does not mean “anything goes”

A 12-ounce drink weighs about 355 grams. My arithmetic: 0.3 percent of that is roughly 1,000 mg of THC. No can on any shelf gets near it. So Florida’s test never limits a drink in practice.

The federal rule does. Congress rewrote the hemp definition in the November 2025 spending law to cap hemp products at 0.4 mg total THC per container. A 2 mg Cann is five times over. A 10 mg Wynk is twenty-five times over. Congress pushed the effective date from November 12 to December 11, 2026, in a stopgap funding bill signed September 2, per the Harris Sliwoski analysis from September 4. I could not find a Florida law that matches the federal cap, so Florida and federal rules do not line up. The full timeline is in my hemp ban explainer.

The National Association of Convenience Stores reported on October 8 that the date still stands without a change in law. Its Coalition for Adult Beverage Alternatives chair expects THC drinks to come back whatever happens in December.

Where to buy THC drinks in Florida right now

Four channels work today.

  1. Target. Target sells hemp THC drinks in more than 300 stores across Florida, Texas and Illinois, plus Minnesota, including Cann and Wynk. The beverage aisle, next to the non-alcoholic beer.
  2. Total Wine, ABC and bottle shops. Beer distributors move these like craft beer. Independent bottle shops carry the widest selection. Ask for the THC cooler.
  3. Convenience stores. Fine for a single can. Poor value for a case.
  4. Online. Brands ship to Florida, and codes take 10 to 25 percent off. My where-to-buy guide covers each channel: where to buy THC drinks before December 11.

Dispensary drinks are a separate category. Florida’s medical marijuana program is a different system with its own rules, and the federal hemp deadline does not touch it.

What I’d buy in Florida before December 11

Every can has a best-by date. Buy what you will finish by spring, not a year’s supply. These are the brands I keep reordering, with the doses printed on the can:

Brand Dose Why it earns a spot Code
Cann 2 mg THC + 4 mg CBD The can I hand to first-timers ALEXANDER15
Wynk 2.5, 5, 10 mg Zero sugar, a real beer swap liftoff20
Willie’s Remedy+ 5 or 10 mg, 750 ml bottle One bottle covers a dinner party LMM10
WIMS 4 mg THC + 4 mg CBD packet Travels better than a can ALEXANDER15
Fable 5 or 10 mg Closest thing to a craft cocktail HERBAL20
Delta Beverages 5, 10, 20 mg Good for experienced drinkers DB25

If you want a gummy instead of a drink, Cornbread Hemp (code HERBALPROFILES) ships to Florida and Dad Grass makes low-dose cans. Every current code lives on the discount codes page.

New to this? Start at 2 to 3 mg and wait 30 minutes before a second can. My dosing guide breaks down 2 mg, 5 mg and 10 mg, and the best THC drinks of 2026 list ranks the full field.

What happens after December 11

Three outcomes are possible. Congress attaches replacement language to the December funding bill, such as the Beverage Regulatory Parity Act that Reps. Van Duyne and Landsman introduced August 10. Congress does nothing and drinks lose federal hemp status. Or Congress extends the date again; attorneys have discussed a second extension to March, though the administration reportedly will not request one. I’ll update this page the day any of those happen. The weekly newsletter sends the same update on Friday.

FAQ

Are THC drinks legal in Florida?

Yes, for adults 21 and older, as of October 12, 2026. Florida regulates them under its general hemp extract law and sets no per-can milligram limit. The federal 0.4 mg per-container cap takes effect December 11, 2026 unless Congress changes it.

How old do you have to be to buy THC drinks in Florida?

21. State law bars selling hemp extract products meant for ingestion to anyone under 21, and FDACS rules require stores to confirm age before a sale or delivery. Underage sales carry a $5,000 fine per occurrence.

Can I buy THC drinks at Target in Florida?

Yes. Target sells hemp THC drinks in more than 300 stores across Florida, Texas and Illinois, plus Minnesota. Cann and Wynk are among the brands. Stock varies by store.

Will THC drinks be illegal in Florida after December 11?

Florida’s own rules do not change on that date. The federal hemp definition does. Products above 0.4 mg of total THC per container lose hemp protection, which covers nearly every drink sold today. Whether Congress fixes it is unsettled.

Can I order THC drinks online to Florida?

Yes. Brands ship to Florida today, and orders must clear an age check. Check each brand’s shipping page, since state lists change.
